A Guideline for Freight and Customs Clearance for the 6th East Asian Games

  Preface

  This manual is the guideline for freight and customs clearance for the 6th East Asian Games, which includes customs, inspection and quarantine policies, range of exemption, entry port and key dates and contact manner etc. We recommend that NOCs delegations attending the 6th East Asian Games read this manual carefully and understand the contents and follow the procedures described herein.

  Tianjin Organizing Committee has established a Freight and Customs Clearance team, which includes Tianjin 2013 East Asian Games Comprehensive Logistics Exclusive Supplier and several recommended international freight and customs clearance service provider etc. Please do not hesitate to contact us for any inquiry in connection with freight.

  NOCs are strongly recommended to review Tianjin Organizing Committee website: https://sports.enorth.com.cn/eag/ for the latest version of this manual (including Appendices and Tables therein), as we may update the manual as needed from time to time prior to the 6th East Asian Games.

  Terms and Definitions

  The following words and terms, as used in the manual, shall have the meanings attributed to them as follows:

  (a) “Bill of Lading” means a document that covers transport of goods by sea. Issued by the carrier to the consignor, it serves as a receipt for the goods, as evidence of the contract of transport and as a document of title to the goods. Bills of Lading are fully negotiable instruments. Transfer of the Bill of Lading transfers ownership of the goods from one party to another.

  (b) “China Customs Authority” means the Chinese Government Agency with the administrative authority to exert control and supervision over the import and export of goods in the territory of China.

  (c)“Commitment Letter on Letter of Guarantee” means the document that Tianjin Organizing Committee requires Customers to sign agreeing to re-export materials after the Games in case Customers shall go through the customs clearance formalities for Temporary Inward Materials based on the Letter of Guarantee issued by Tianjin Organizing Committee.

  (d) “Tianjin Organizing Committee” means the Tianjin East Asian Games Organizing Committee, who is responsible to organize the 6th East Asian Games.

  (e) “Entry-Exit Inspection & Quarantine Authority” means the entry-exit inspection & quarantine bureaus and their branches established by the General Administration of Quality Supervision, Inspection and Quarantine throughout the country, who shall be responsible to carry out the quarantine for import and export materials, entry-exit sanitation quarantine, entry-exit animals and plants quarantine, and the safety, certification, supervision and administration of entry and exit food etc.

  (f) “International forwarder” means the enterprises accepting the commission of consignors and consignees of entry and exit articles, going through the international articles transport and relevant businesses for the client in the name of the client or in its own name.

  (g) “House Air Waybill” means a document issued by the forwarder clearly showing the contract of affreightment between the forwarder and the exporter.

  (h) “Letter of Evidence of Inward Materials for the 6th East Asian Games” means the document provided to Customers or their forwarders by Tianjin Organizing Committee for efficient and fast customs clearance. The letter serves as the certificate stating that the inward materials will be used for the 6th East Asian Games.

  (i) “List of Inward Materials for the 6th East Asian Games” is the document specifically designed for Games related materials entering into China which will cover information like the consignor, the consignee, forwarder and material information etc.

  (j) “Master Airway Bill” means a document issued by the originating airline when and if a shipment involves more than one air carrier. An Airway Bill is the document that covers transport of goods by air. It is issued by the carrier, whether an airline or a forwarder, to the consignor as a receipt for the goods and as evidence of the conditions of transport. It also shows details of the consignee so they can be contacted when the goods arrive. Note that unlike the Bill of Lading, an Airway Bill is not a fully negotiable instrument.

  (k) “Related Department of Tianjin Organizing Committee” means the Department or Functional Area within Tianjin Organizing Committee that is responsible to manage or coordinate the activities of a particular East Asian Games Family member.

  (l) “Guarantee Letter for Personal Use” means the document provided to Customers by Tianjin Organizing Committee identifying the goods of the NOCs for personal use.

  (m) “Venues” means the official sites and locations at which the 6th East Asian Games are held, including competition venues and training venues, as well as non-competition venues, such as the the Main Media Centre and the OCA Headquarters Hotels etc.

  Section 2 Policies

  2.1 Services & Charges

  2.1.1 International Freight

  Tianjin Organizing Committee will recommend Sinotrans Limited as the international freight forwarders for all NOCs, however it is NOCs’ responsibility to bear the related international freight charges.

  NOCs may elect their own freight forwarders other than the recommended by Tianjin Organizing Committee.

  Any NOC electing to use its own international freight forwarder must inform Tianjin Organizing Committee of their choice three months prior to the arrival of shipment and provide us with the freight forwarder’s name and details, and any assistance that might be needed from Tianjin Organizing Committee.

  We strongly recommend that NOCs use the same international freight forwarder that it uses to bring equipment to China for the Games to send team equipment home after the Games.

  2.1.2 Customs Clearance

  NOCs may elect their own customs clearance service providers or Sinotrans Limited which is the recommended by Tianjin Organizing Committee. Any NOC electing to use its own service providers must inform GAGOC of their choice three months prior to the arrival of shipment and provide us with the service provider’s name and details, and any assistance that might be needed from Tianjin Organizing Committee. Please note that we will issue, to NOCs, the documentation needed to facilitate a shipment’s clearance through customs, including the East Asian Games Freight Certification Letter and Customs Declaration Warrant, and other corresponding assistance.

  Tianjin Organizing Committeewill not be responsible for any custom clearance fees.

  It is suggested that NOCs use the same service provider to undertake customs clearance formalities that it uses to ship equipment to and from China, for the Games.

  Inward materials for the 6th East Asian Games which is guaranteed by Tianjin Organizing Committee shall be undergone the temporary inward formalities with Tianjin Port uniformly.

  The relevant approval certificates must be obtained when bringing in goods and materials normally restricted entry under Chinese laws, in order to clear customs. Restricted goods include animals, plants, animal or plant products, wild animals and plants, horses and supporting materials, food, beverages, medicines, sporting guns and ammunition for Games use, radio communication equipment and instruments, foreign journalists’ and photographers’ equipment used to conduct interviews, ground-receiving equipment of satellite television, wooden packaging materials and inward means of foreign transportation. See Appendix 1 for details.

  2.1.3 Inspection and Quarantine

  The imported items such as sample products, gifts, temporary admission entry goods and other non-tradable articles, are exempted from inspection, except as otherwise stipulated by Chinese laws or administration regulation. For batteries, used machinery & electronic products, food, cosmetics that are for the NOC members’ own use, and the self-used goods required for CCC, participating Delegation should apply for inspection and quarantine based upon the guarantee document issued by Tianjin Organizing Committee. If the imported goods will continue to be used or will be resold in Chinese market after the Games, compulsory certification procedures or other related action must be taken.

  The self-used food, animals, plants and their products brought in by the 6th East Asian Games delegations and their team members must be declared collectively as imported cargo. Such goods can not be brought in as personal baggage; otherwise they will be confiscated and destroyed.

  Certain food, animals, plants and their products are prohibited from entering into Chinese territory pursuant to provisions of Chinese government. See Appendix 1 for details.

  2.1.4 Local Movement and Storage for NOCs

  Sinotrans Limited has been appointed by Tianjin Organizing Committee to deliver materials (boats) of NOCs from designated point of entry to Game venues free of charge.

  Tianjin Organizing Committee will not cover local freight charges for NOCs who wish to use their own transport service providers. Any NOCs wishing to ship goods or equipment using their own service providers must notify Tianjin Organizing Committee of their intention to do so before June 6, 2013 so that we can issue appropriate passes for vehicles and staff to enter and exit Games venues.

  If, for some reason, a NOCs’ nominated transport service provider fails to obtain the necessary access passes for vehicles or staff, they will need to forward all relevant freight documents and receipts to Sinotrans Limited after it has cleared the goods through customs. Sinotrans Limited will then arrange for the goods to be transported to their designated destination.

  Tianjin Organizing Committee has arranged for a special warehouse to be available to store NOCs’ boats to be used in competition. It is each NOC’s responsibility to maintain and store any other team equipment.

  2.1.5 Local Movement and Storage for other Customers

  Customers other than NOCs mentioned above shall arrange their domestic movement and storage at their own expenses. Sinotrans Limited exclusively appointed by Tianjin Organizing Committee and the customs clearance service provider recommended by Tianjin Organizing Committee will provide the domestic movement and storage for other customers with charges. Other customers may arrange the domestic movement and storage of materials at their own discretion.

  2.1.6 Insurance

  Customers shall voluntarily purchase and maintain the transport insurance for materials in and out of China, and the property insurance during storage as well.

  2.2 Guarantee for Temporary Inward Materials

  Letter of Guarantee issued by Tianjin Organizing Committee will be available upon application for Temporary Inward Materials for Games use, provided that customers will re-export the materials out of China after Games at the time prescribed, under which cases no import taxes or tariff will be collected. Customers shall pay penalties and taxes to China Customs in case the Temporary Inward Materials are not re-exported at the time prescribed. If temporary Inward Materials will be sold within Chinese territory, the normal import formalities shall be gone through and import taxes shall be paid. For Games-used materials of temporary imported, if not using the bank guarantee provided by Tianjin Organizing Committee, NOCs should submit a deposit that equals to the tax amount to the custom, or any other guarantee that lawfully admitted by the custom.

  2.3 Entry of Sporting Guns and Ammunition

  Sporting guns and ammunition must be approved by General Administration of Sport of China before being brought into China. And observe the formalities of Station of Exit and Entry Frontier Inspection and China Customs, to obtain the required certificate.

  The number of sporting guns and ammunition brought into China by athletes competing in shooting events and/or the Modern Pentathlon must be consistent with the number given in the application form, to be submitted when applying for permission to bring such equipment into the country.

  Sporting guns and ammunition to be used during the Games must be packed separately and brought into China along with the athlete’s personal luggage.

  Sporting guns and ammunition not consumed during the Games must be taken by athletes and accompany them when leaving China.

  During the Games, Tianjin Organizing Committee will operate a Guns and Ammunition Entry and Exit Declaration Office at entry and exit ports.

  Tianjin Organizing Committee will be responsible for transporting and maintaining guns. All the firearms and ammunition must be stored in warehouse in shooting range, and return in accordance with the procedure. Please refer to the guidelines for the management of sporting guns and ammunition in shooting event for regulations governing specific issues related to guns and ammunition including their application and use.

  2.4 Entry of Medicine

  All NOCs must declare all medicines (including veterinary drug) and medical instruments shipped into China before 2013-3-31, Medicines and medical instruments are only permitted to be used by members of the delegation itself. Unconsumed medicines and medical instruments must be transferred to a port of departure and leave China within one month of the Games ending.

  2.5 Entry of Food and Drinks

  Certain food is prohibited from entering into China in accordance with the provisions of China’s food quarantine authority, please refer to https://sports.enorth.com.cn/eag/ for details. For self-used food and drinks for Games use and directly brought into China by East Asian Games Family members, the Customs will, after quarantine, release the same against relevant certification documents by Tianjin Organizing Committee.

  2.6 Entry of Radio Telecommunication Equipment

  Radio telecommunications equipment are allowed to be imported, erected and used after completing the required application and approval procedures.   2.7 Entry-Exit Ports

  To facilitate the customs clearance process, we strongly recommend that the following ports be used for importing materials for Games use:

  Section 3 Required Documents for Customs Clearance

  1. List of Imported Materials for the 6th East Asian Games (Appendix 3);

  2. Requirement for imported wooden packing materials: wooden packing materials for imported goods shall be treated by the enterprises certified by the plant quarantine authority of export countries or regions governments against the quarantine and disinfecting method certified by China, and shall be labelled the IPPC Specific Mark approved by the plant quarantine authority of the export countries or regions governments (Appendix 4);

  3. Freight Authorization Letter (Appendix 5) issued by the Customer to the Forwarder;

  4. Approval documents for special materials i.e. Permit for radio frequency etc;

  5. Letter of Evidence of Inward Materials for the 6th East Asian Games (See Appendix 6) and the Guarantee Letter for Personal Use (Appendix 7);

  6. Transportation documents:

  Sea transport: Bill of Lading provided by the carrier;

  Air transport: Master Airway Bill provided by airlines and House Air Waybill provided by forwarder;

  Land transport: consignment bill provided by forwarder.

  7. Test report on special materials: animal derived food, for example, should offer the illicit drugs test report issued by designated test institute.

  Section 4 Working Procedures

  Step 1: Signing of Commitment Letter on Letter of Guarantee for Temporary Inward Materials

  Customers shall contact related department of Tianjin Organizing Committee and sign the “Commitment Letter on Letter of Guarantee for Temporary Inward Materials” (Appendix 8) to guarantee that the Temporary Inward Materials are genuine and that they will re-export the materials out of Chinese territory after the Games. Customers shall deliver the Commitment Letter immediately upon the signing thereof.

  Step 2: Completing the list of materials imported for the 6th East Asian Games

  Please send the list to related department of Tianjin Organizing Committee through e-mail or fax three months in advance.

  Please clearly complete the items in the List of Inward Materials for the 6th East Asian Games, and indicate the handling of materials: being re-exported after the Games, consumed or discarded during the Games.

  Step 3: Preparing Materials Packing, Marking and Labelling

  1. Packing

  Appropriate packing is a critical factor ensuring the secure transport of materials from the source of origin to the destination.

  Materials for re-exportation shall be contained in secure and recyclable containers which shall be pegged.

  Temporary Inward Materials and consumables shall be packed separately, for which separate packing list shall be used lest the delay in customs clearance.

  Recommendations: foam or other fillings shall be used in case the case is not fully packed with material; fragile articles shall be packed additionally and the case of which shall be marked “Fragile”. All paper cases shall be reinforced at the bottom with strong protective tapes.

  Ensure to distribute the weight of case evenly if the case will be borne by only one pallet. Stack cases square to each other and to the pallet (not suspending on each other) Ensure that the upper side of pallet will be flat to reduce loss or damage risk of paper cases.

  Heavy articles shall be placed on the bottom, on which shall be put the light articles.

  Please be reminded that customers shall store the packing materials during the Games.

  2. Marking and Labelling

  All cases shall be explicitly marked and numbered in consistent with those in “List of Inward Materials for the 6th East Asian Games”. Please indicate the following information: consignor, event name, venues, consignee, mode of transport, case No./ packing case No. (e.g. first case among six cases), weight (kg), shipping port and destination port.

  Please be noted that, to facilitate the inspection and quarantine, marking shall be applied to the legible part of wooden packing materials and at least on opposite sides of the packing materials. The marking shall be clear, visible and permanent, and shall not be in red or orange.

  Step 4: Selecting and Authorizing International Forwarder and Customs Clearance Service Provider

  Customers may choose the international forwarder and customs clearance service provider recommended by Tianjin Organizing Committee or, they may choose the forwarder or service provider at their own discretion and execute the “Freight Authorization Letter” with the authorized international forwarder and customs clearance service provider.

  Step 5: Issuing Freight Information to Related Department of Tianjin Organizing Committee

  Pursuant to the shipment of materials, customers shall send all documents to related department of Tianjin Organizing Committee through fax or e-mail. See Step 1 for contact method of related department of Tianjin Organizing Committee.

  Step 6: Issuing Customs Clearance Documents by Tianjin Organizing Committee

  Related department of Tianjin Organizing Committee will verify the documents of list of Temporary Inward Materials etc and will provide the customs clearance documents and inspection-related documents (including certification documents authorizing to use letter of guarantee) required for the entry of the materials to the forwarder and customs clearance service provider authorized by Customers.

  Step 7: Completing the Preparation of all Documents by Forwarder

  See Section 3

  Step 8: Going Through Customs Clearance by Forwarder with the Customs and Inspection and Quarantine Authorities

  Forwarder shall go through the formalities for the temporary entry of the materials based upon the relevant documents furnished by Tianjin Organizing Committee.

  Step 9: Receiving Delivery Materials at the Destination Venue

  Customers or their authorized forwarders must receive the materials at the venues.

  See Section 5 for details.

  Step 10: Re-exporting Materials out of Chinese Territory after the Games

  China customs will make the record for your materials entering Chinese territory until your materials are re-exported against the packing list or are consumed.

  Prior to re-exporting the Temporary Inward Materials, customers or their authorized forwarders shall contact with the logistics centre of Tianjin Organizing Committee to cancel the line of credit of Letter of Guarantee used for the materials.

  Forwarder authorized by customers shall provide the following documents when re-exporting materials: list of materials for re-exportation and list of original materials etc.

  Taxes and other fees may be collected in case of any difference between the imported quantity and re-exported quantity of materials.

  Section 5 Bump In & Bump Out

  5.1 Prior to Lock Down Period

  Prior to the lock down period of the 6th East Asian Games venues, forwarder shall transport materials to the 6th East Asian Games venues with Bump In Pass before it is allowed to enter into the venues.

  5.2 During Lock Down Period

  During the lock down period, vehicles transporting materials shall bear the East Asian Games Vehicle Permit and EAGIAC and shall accept security checks like goods scanning etc before transporting into venues. The lock down period shall start seven days before commencement of the 6th East Asian Games and end two days after the Games.

  In case no East Asian Games Vehicle Permit and EAGIAC is available for the carrier, driver and vehicles for the transporting materials shall not be allowed to enter venues, while goods contained in the vehicle may be discharged at the agreed spot beyond the venue security line and loaded on the vehicle certified by Tianjin Organizing Committee. Customers or their authorized forwarders shall receive the materials at the said spot after the Games.

  5. 3 After Lock Down Period

  Any carrier intending to move materials out of the 6th East Asian Games venues after the lock down period shall do the same with a Bump Out Pass.

  Appendix 1

  Guide to Customs Clearance for Materials for Tianjin 2013 East Asian Games

  China Customs is committed to providing all-round quality services for the Tianjin 2013 East Asian Games (hereinafter referred to jointly as the “Games”) and handling the customs control and clearance procedures for incoming and outgoing Games materials in accordance with relevant laws, regulations and rules of the P.R.C.

  This Guide applies to the handling of Customs formalities and the payment of Customs duties and import taxes collected by China Customs on behalf of other government agencies of China for relevant incoming and outgoing materials for the Games, test events, and other Games-related activities during the Games and the preparation period.

  “During the Games and the preparation period” refers to the period from 2012-10-15 to 2013-11-16.

  In accordance with the policies set by the State Council, categories and quantities of incoming and outgoing materials for the Games entitled to duty and/or tax relief should be pooled by the Tianjin East Asian Games Organizing Committee (hereinafter referred to as “Tianjin Organizing Committee”) and submitted to relevant government authorities for examination before being determined. Where materials arrive at relevant ports before the government authorities make the decision, China Customs will inspect and verify the Letter of Certificate for Inward Materials for Tianjin 2010 East Asian Games (hereinafter referred to as the “Letter of Certificate”; see Appendix 6 for details) issued by Tianjin Organizing Committee’s financial department with the authorization of Tianjin Organizing Committee, and go through the customs clearance formalities for the materials accordingly provided that a valid security is supplied.

  I. Temporarily Admitted Materials

  A. Incoming Materials Carried by Individuals

  Sports apparatuses, medical equipment and other relevant Games materials carried by members of the East Asian Games Family must be declared to China Customs at the time of entry and exit. Those to be directly used for the Games will be admitted temporarily and shall be taken out of the Chinese mainland after the Games on time.

  B. Materials Entering as Goods

  Sports apparatuses, medical equipment, security facilities, communications equipment, TV-broadcasting and news-reporting instruments, equipment and materials for exhibitions and the like entering as goods must be declared to China Customs at the time of entry and exit. China Customs will inspect and verify the validity of the security deposit (or the Letter of Guarantee issued by an authorized bank) and the Letter of Certificate issued by Tianjin Organizing Committee, and handle the customs clearance formalities accordingly.

  C. Reporting Equipment Carried by Overseas Journalists

  Reporting equipment carried by overseas journalists holding the East Asian Games Identity Accreditation Card (EAGIAC) must be declared to China Customs at the time of entry and exit. China Customs will inspect and verify the Letter of Certificate, the validity of security deposit (or letter of guarantee) and the list of the equipment, and handle the customs clearance formalities accordingly.

  For reporting equipment carried by overseas journalists not holding EAGIAC, customs clearance formalities will be handled in accordance with Announcements No. 104/2008, No. 19/2009 and No. 31/2009 promulgated by the General Administration of China Customs.

  In carrying the reporting equipment out of the Chinese mainland, overseas journalists may, at the place of exit, get the refund of the security they deposited at the place of entry, in accordance with Announcement No. 59/2009 promulgated by the General Administration of China Customs.

  D. Time Limit for Temporary Entry

  Materials temporarily admitted with the approval of China Customs shall be re-exported out of the Chinese mainland within six (6) months as from the date of entry. Under exceptional circumstances where an extension is required, an extension may be granted upon approval of China Customs to which an application must be filed through Tianjin Organizing Committee, but the deadline of re-exportation shall not be later than 2013-4-5.

  E. Closing of Case over Temporary Entry

  Temporarily admitted materials for the Games shall be re-exported out of the Chinese mainland within the time limit prescribed by China Customs. For temporarily admitted materials for the Games which fail to be re-exported within the prescribed time limit, relevant procedures shall be gone through in accordance with related legal provisions.

  In case any temporarily admitted materials are damaged, destroyed, lost or have lost their useful value due to force majeure, China Customs will inspect and verify the documentary evidence provided by relevant authorities, and go through relevant formalities accordingly.

  II. Inward Materials Exempted from Duties and/or Taxes

  According to relevant laws, regulations and rules of the People’s Republic of China, the following materials may be admitted duty-free:

  A. Articles for Personal Use

  1. Personal items carried by individuals

  In carrying articles for general daily use into the Chinese mainland, members of the East Asian Games Family shall follow the principle of “self-use and reasonable quantities”. China Customs will release their self-use articles duty-free provided that the quantities are within the prescribed reasonable range. Customs clearance procedures for articles beyond “self-use and reasonable quantities” will be otherwise handled by China Customs in accordance with relevant legal provisions.

  2. Personal items entering or leaving as unaccompanied luggage

  Articles for personal use of members of the Asian Games Family entering as unaccompanied luggage will be released by China Customs duty-free provided that the said self-use articles are within the prescribed duty-free range. Customs clearance procedures for such articles beyond “self-use and reasonable quantities” will be otherwise handled by China Customs in accordance with relevant legal provisions.

  3. Postal personal items

  For parcels coming from a foreign country, the value of each parcel shall not exceed RMB1,000 yuan, and the parcel will be exempted from Customs duties if its value does not exceed RMB500 yuan. For parcels coming from Hong Kong China, Macau China or Chinese Taipei, the value of each parcel shall not exceed RMB800 yuan, and the parcel will be exempted from Customs duties if its value does not exceed RMB400 yuan. Where the value of a parcel exceeds the duty-free amount, Customs duties will only be levied over the excess part.

  B. Donated Materials

  Materials gratuitously donated by foreign governments or international organizations for sports events of the Games will be cleared by China Customs duty-free against the Certificate for Materials Gratuitously Donated by Foreign Governments or International Organizations or Imported to Fulfill China’s International Obligations. For donated materials other than those mentioned above, the customs clearance formalities will be handled otherwise in accordance with relevant legal provisions.

  C. Exhibition Items

  For the following incoming exhibition items to be used in exhibitions for the Games, China Customs will verify their quantities and total value, and exempt them from customs duties, import VAT and excise duties provided that the quantities and the total value of the items fall within a reasonable range:

  1. Small samples used in exhibition activities (alcoholic drinks, tobacco products and fuels are excluded), including samples of foodstuff and drinks imported in their original form or made from imported bulk materials during the exhibitions.

  The above-mentioned small samples shall meet the following conditions for exemption:

  (a) provided free of charge by exhibitors and intended solely for distribution during an exhibition for free use or consumption by visitors;

  (b) Of a low unit value and used as promotional samples;

  (c) Not suitable for commercial use with the unit volume obviously smaller than the smallest retail volume in the market; or

  (d) Samples of foodstuff and drinks not packaged in a way required in item (c) of this paragraph but truly have been distributed and consumed in the exhibitions.

  2. Items consumed or damaged for operation demonstration of exhibited machines or parts/components.

  3. Low-value goods consumed in setting up and/or decorating a temporary exhibit.

  4. Relevant publicity materials distributed to visitors for free during the exhibition.

  5. Documentation, forms and other files used for exhibitions.

  Where the quantity of an incoming exhibition item listed in the abovementioned Paragraph 1 exceeds the prescribed reasonable range, duties and/or taxes will be levied over the excess part in accordance with law; Exhibition items listed in Paragraphs 2, 3 and 4 which are not used or not used up shall be re-exported out of the Chinese mainland. If they are not re-exported, import formalities shall be gone through in accordance with relevant legal provisions.

  D. Printed Matters and Audio-Visual Products

  Files, books, as well as other printed matters and audio-visual products, which are directly used for the Games and not of a trading nature and will not be sold or circulated on the domestic market of China, will be managed by China Customs in accordance with relevant legal provisions.

  III. Other Inward Materials

  Except for the above-mentioned Games materials temporarily admitted and those exempted from duties and/or taxes, all other inward materials shall be put under the import procedures and payment of duties and/or taxes shall be made as prescribed by law.

  IV. Leased Materials

  For Games materials imported on lease, China Customs will handle the customs clearance formalities in accordance with the administration procedures regarding import of general leased goods.

  V. Inward and Outward Materials Requiring Special Approval As Prescribed by Law

  For the following inward and outward Games materials requiring special approval as prescribed by law, relevant certificates issued by competent authorities of China shall also be presented:

  A. Animals, Plants and Products Thereof

  The entry and exit of animals, plants and products thereof shall comply with relevant laws and regulations of the People's Republic of China on entry/exit sanitary and phytosanitary quarantine. China Customs will inspect and verify the regulatory certificates issued by competent authorities of China, and handle the customs clearance procedures accordingly.

  B. Wild Animals and Plants

  The entry and exit of wild animals and plants shall comply with the laws and regulations of the People's Republic of China concerning the protection of wildlife. Prior to export of wild animals and plants listed by Chinese government for priority protection or the products thereof, and prior to import or export of wild animals and plants or the products thereof whose import or export is restricted by international conventions to which China is a party, approval must be obtained from the competent administrative authorities for wildlife protection under the State Council of China, and a certificate issued by the Chinese national authority for administration of import and export of endangered species must be obtained to prove the import and export is allowed. China Customs will inspect and verify the licensing document(s) issued by competent authorities of China, and handle the customs clearance procedures accordingly.

  C. Horses and Related Supporting Materials

  The entry and exit of competing horses and related supporting materials shall comply with the policies specially set for them by the competent authorities of the P.R.C. China Customs will inspect and verify the licensing document(s) issued by competent authorities of China, and handle the customs clearance procedures accordingly.

  D. Drugs

  The entry of drugs shall comply with the laws and regulations of the P.R.C concerning the administration of drugs. An application shall be filed with the Chinese drugs administration authority for entry of drugs, including both special drugs and general ones, to obtain related licensing or approval documents. China Customs will inspect and verify relevant documents and handle the customs clearance procedures accordingly.

  E. Sport Guns and Ammunition for the Games

  The entry and exit of sport guns and ammunition used for the Games shall comply with the laws and regulations of the P.R.C concerning control over sport guns and ammunition. Entry and exit of any sport guns or ammunition must have the prior approval by the police authority of China. China Customs will inspect and verify the related certificates issued by the police authority, and handle the customs clearance procedures accordingly.

  During transportation, a sport gun must be separated from its ammunition and from its user. The related parties or persons must comply with the legal provisions concerning administration of firearms and ammunition. Sport guns and un-consumed ammunition must be re-exported out of the Chinese mainland after the Games.

  F. Radio Transmission Equipment and Instruments

  Entry of radio transmission equipment and instruments shall comply with the relevant laws and regulations of the P.R.C.. China Customs will inspect and verify the approval documents issued by competent national authorities of China, and handle the customs clearance procedures accordingly.

  G. Ground Receiving Equipment of Satellite TV Broadcasting

  Entry of ground receiving equipment of satellite TV broadcasting shall comply with relevant laws and regulations of the P.R.C.. China Customs will inspect and verify the approval documents issued by competent national authorities of China, and handle the customs clearance procedures accordingly.

  H. Wooden Package Materials

  Entry of wooden package materials shall comply with the relevant laws and regulations of the P.R.C.. China Customs will inspect and verify related certificates and documents, and handle the customs clearance procedures accordingly.

  I. Inward Foreign Means of Transport

  Entry of foreign means of transport shall comply with the relevant laws and regulations of the P.R.C.. China Customs will inspect and verify the approval documents issued by competent national authorities of China, and handle the customs clearance procedures accordingly.

  J. Others

  Other materials for the Games requiring special approval as prescribed by law shall also comply with the provisions of relevant laws and regulations of the P.R.C..

  VI. Materials Prohibited from Entry

  A. Opium, morphine, heroin, marijuana and other addictive narcotics and psychotropic substances (Under exceptional circumstances which require entry for medical purpose, these narcotics and substances may be imported into the Chinese mainland provided that a license by relevant authorities is granted).

  B. Firearms, simulated weapons, ammunitions and explosives of all kinds (those for use of the Games are excluded).

  C. Animals, plants and the products thereof infected with or carrying dangerous germs, viruses, pests and other hazardous organisms.

  D. Printed matters, audio-visual products, storage media for computers and other articles which are harmful to the political, economic, cultural and moral interests of China.

  E. Deadly poison of all kinds.

  F. Foodstuff, medicines and other articles coming from epidemic stricken areas, harmful to men or livestock, or capable of spreading diseases.

  G. Counterfeit currencies and counterfeit negotiable securities.

  H. Other goods and articles prohibited from entry in accordance with laws and regulations of China.

  VII. Others

  A. Recommended Ports of Entry

  The following ports are recommended by Tianjin Organizing Committee as places of entry and exit for materials for the Games:

  1. Airports: Tianjin Binhai International Airport, Beijing Capital International Airport

  2. Sea ports: Tianjin Port

  3. Land border stations: Tianjin

  B. Lists of Materials Submitted in Advance

  To facilitate customs clearance, lists of articles (see Appendix 3 for the format) to be carried or transported into the Chinese mainland by participating delegations must be submitted to Tianjin Organizing Committee or agencies designated thereby at least three months before arrival.

  C. Customs Clearance Models

  1. Passengers

  OCA officials, IOC officials and foreign government officials, who hold diplomatic or courtesy visas, will enjoy exemption from Customs inspection at the time of entry and exit. For other passengers, if a passenger has carried nothing to declare to China Customs, he/she doesn’t need to declare, and may take the Green Passage (Nothing-to-Declare Passage) for customs clearance; if a passenger carries anything that should be declared to China Customs, he/she shall declare to China Customs in written form and shall take the Red Passage (Goods-to-Declare Passage) for customs clearance.

  2. Unaccompanied Luggage of Members of the East Asian Games Family

  Personal items of members of the East Asian Games Family transported into the Chinese mainland as unaccompanied luggage shall be declared to China Customs in written form by the members themselves or their agents, and customs clearance formalities shall be gone through with the Customs house at the place of entry upon the strength of their valid identity certificates, relevant declaration documents, list of articles, etc. For personal items to be re-exported out of the Chinese mainland as unaccompanied luggage, applications shall be lodged in advance with the Customs house at the place of exit by the members themselves or their agents upon the strength of valid re-exportation certificates, and customs clearance procedures shall be gone through in accordance with relevant legal provisions.

  3.Materials for the Games

  Materials for the Games may be cleared by China Customs using the model of sealing at ports of entry and inspecting and releasing at final destination.

  D. General Guarantee for Materials for the Games

  Where a guarantee is required for any inward or outward materials for the Games, Tianjin Organizing Committee shall provide a general guarantee to cover the related Customs duties and taxes. Where conditions have been met for lifting the guarantee for duties and taxes, China Customs will go through relevant procedures accordingly.

  China Customs will exercise control over inward and outward materials for the Games in accordance with relevant laws, administrative regulations and rules, such as the Customs Law of the People's Republic of China and the Regulations of the People's Republic of China on Import and Export Duties. Where customs procedures fail to be gone through for inward and outward materials for the Games, China Customs will deal with the materials and related parties in accordance with the Regulations of the People’s Republic of China on Implementing Customs Administrative Penalty and other relevant legal provisions.

  This Guide does not affect the implementation of new regulations on Customs administration.

  Appendix 2

  Instruction on Inspection and Quarantine of the Entry-Exit People and Articles for Tianjin 2013 East Asian Games

  Please read the following information carefully so that you and your imported articles can enter and leave the territory of the People’s Republic of China smoothly during the period of the 6th East Asian Games.

  I. The following imported items, namely sample products, gifts, temporarily permitted entry goods and other non-tradable articles are exempted from inspection, except as otherwise stipulated by laws or administration regulation.

  II. When declaring imported items, namely batteries, used machinery & electronic products that are for the East Asian Games family members’ own use, participating Delegation should submit the Guarantee Letter for Personal Use issued by Tianjin Organizing Committee to the inspection and quarantine officials, who in turn will take all the necessary registration procedure, it is important to note that records of such goods will only be kept at the entry port but not in the China Inspection and Quarantine.

  III. When declaring imported items on the catalogue of objects subject to compulsory certificate brought in by the East Asian Games family members, participating Delegation should submit the Guarantee Letter for Personal Use issued by Tianjin Organizing Committee to the inspection and quarantine officials, who in turn will take all the necessary registration procedure. When re-exporting such items after the Games, participating Delegation should submit the original Customs Declaration Forms again so that their imported goods record could be canceled after verification. If the imported goods continue to be used or resold after the Games, compulsory certification procedures or other action must be taken.

  IV. When declaring imported items, namely food and cosmetics used only by the East Asian Games family members, participating Delegation should submit the Guarantee Letter for Personal Use issued by Tianjin Organizing Committee to the inspection and quarantine officials. It is important to note that such imported items will be exempted from label verification and will not be required to put Chinese label or marking in Chinese on them.

  V. When declaring imported items, namely biological products and blood products that are brought into the territory of China by the East Asian Games family members for their own use, provided that quantity of such imported goods remains reasonable and there is no any violations of related rules and regulations, participating Delegation should submit the Guarantee Letter for Personal Use issued by Tianjin Organizing Committee, import inventory and related certificates to the inspection and quarantine officials, who in turn will discharge such goods provided that all those documents are correct. The entry of the blood, micro-organism, human tissues, the biological products, blood products that are not self-used, should be subject to sanitary quarantine in compliance with the relevant requirements in Regulations for Administration of Entry and Exit Health Quarantine on Special Goods.

  VI. The entry of food, animals and plants and their products for the 6th East Asian Games should meet the following requirements:

  1. The entry of food, animals and plants and their products which are required import quarantine approval (listed in Annex 1.) should go to the authorized inspection and quarantine units of General Administration of Quality Supervision, Inspection and Quarantine (AQSIQ) for such approvals beforehand.

  2. The aforesaid imported goods shall enter the territory of China at the port stipulated in the approval document of AQSIQ, and be stored at the designated warehouse. If the entry port is not the destination where the goods would be used, the goods shall be supervised and inspected by the inspection and quarantine authorities of the destination sites.

  3. The consignee or his agent of the entry of food, animals and plants and their products for the 6th East Asian Games shall register their company’s credentials at the inspection and quarantine authority of the entry port before they sign the contract.

  4. The aforesaid goods shall comply with the requirements of the food safety standard set by the Tianjin Organizing Committee. If Tianjin Organizing Committee does not set clear requirements for some goods, such goods shall comply with the relevant requirements of the Joint Announcement No.72, 2009 of AQSIQ and the Ministry of Health.

  5. The aforesaid imported goods will be shipped from the port of entry directly to its destination place under the supervision of the inspection and quarantine authorities, who will carry out the inspection and quarantine after the arrival of such goods.

  VII. Inspection and quarantine of the self-used food, animals and plants and their products for the 6th East Asian Games delegations and their team members shall be conducted in accordance with the following requirements:

  1. The goods explicitly prohibited by the Chinese government (see Annex 2) are not allowed to be brought into the territory of China.

  2. For the entry of food, animals and plants and their products which are required quarantine approval and have been approved to import by inspection and quarantine authorities (listed in Annex 4, 5, 6), the list of goods for personal use, guarantee documents of personal use, the statement of taking responsibility for sanitation and safety of self-used goods, certificate of origin and valid quarantine certificates shall be submitted to Tianjin Organizing Committee in advance, provided that quantity of such imported goods remains reasonable and there is no any violations of related rules and regulations. Tianjin Organizing Committeewill in turn submit the above-mentioned documents to the inspection and quarantine authorities, together with the Guarantee Letter for Self-used Goods from Tianjin Organizing Committee, applying for Inspection and Quarantine Approval on participating Delegation’s behalf.

  Once the Inspection and Quarantine Approval is granted, the inspection and quarantine officials will only verify the approval documents and conduct on-site inspection upon the entry of the goods. Provided that the actual imported goods are agreeable with the approval documents and no harmful organisms are found, the goods will be discharged and can be directly shipped to the Athletes’ residence of 6th East Asian Games.

  Self-used goods entering Athletes’ residence will be supervised by the inspection and quarantine authorities, and those remaining goods after the Games shall be re-exported or destroyed under the supervision of inspection and quarantine authorities. If the goods need to be re-sold in Chinese market after the Games, the inspection and quarantine authorities must be informed and will take necessary inspection and quarantine action on these goods.

  3. For the entry of food, animals and plants and their products which are required quarantine approval and not listed in the prohibit-entry list, but have not been qualified by the inspection and quarantine authorities to enter the Chinese market (i.e. products not listed in Annex 2 & Annex 3), the list of goods for personal use, guarantee documents of personal use, the statement of taking responsibility for sanitation and safety of self-used goods, certificate of origin and valid quarantine certificates should be submitted to Tianjin Organizing Committee in advance, provided that quantity of such imported goods remains reasonable and there is no any violations of related rules and regulations. Tianjin Organizing Committee will in turn submit the above-mentioned documents to the inspection and quarantine authorities, together with Tianjin Organizing Committee’s Guarantee Letter for Self-used Goods, applying for Inspection and Quarantine Approval on participating Delegation’s behalf.

  Once the Inspection and Quarantine Approval is granted, the inspection and quarantine authorities will only check the approval documents and conduct on-site inspection upon the entry of the goods. Provided that the actual imported goods are agreeable with the approval documents and no harmful organisms are found, the goods will be discharged and can be directly shipped to the Athletes’ residence of 6th East Asian Games.

  Self-used goods entering Athletes’ residence will be supervised by the inspection and quarantine authorities, and those remaining goods after the Games shall be re-exported or destroyed under the supervision of inspection and quarantine authorities.

  4. For the entry of goods which do not require approval of quarantine, the list of goods for personal use, guarantee documents of personal use, the statement of taking responsibility for sanitation and safety of self-used goods shall be submitted to Tianjin Organizing Committee in advance, provided that quantity of such imported goods remains reasonable and there is no any violations of related rules and regulations. Certificate of origin and valid quarantine certificates are not required. Tianjin Organizing Committee shall submit the above-mentioned documents to the inspection and quarantine authorities, together with Tianjin Organizing Committee’s Guarantee Letter for Self-used Goods, applying for Inspection and Quarantine Approval on participating Delegation’s behalf.

  The inspection and quarantine authorities will only check the approval documents and conduct on-site inspection upon the entry of the goods. Provided that the actual imported goods are agreeable with the approval documents and no harmful organisms are found, the goods will be discharged can be directly shipped to the Athletes’ residence of 6th East Asian Games.

  Self-used goods enter into Athletes’ residence will be supervised by the inspection and quarantine authorities, and those remaining goods after the Games shall be re-exported or destroyed under the supervision of inspection and quarantine authorities. If the goods need to be re-sold in Chinese market, the inspection and quarantine authorities must be informed and will take necessary inspection and quarantine action on these goods.

  5. The self-used food, animal, plant and their products brought in by the 16th Asian Games delegations and their team members must be declared collectively as imported cargo. Such goods can not be brought in as personal baggage; otherwise they will be confiscated and destroyed.

  Ⅷ. East Asian Games family members who wish to bring guide dogs and accompanying animals shall comply with the following requirements:

  1. As for guide dogs brought in by the East Asian Games Family members inspection and quarantine authorities will take on-site quarantine actions, requesting effective animal quarantine certificates, vaccination against rabies certificate and guide dog training certificate issued by the animal and plant quarantine authorities of the source countries or regions. The aforesaid dogs can be discharged after passing the on-site quarantine.

  2. As for the athletes, umpires participating in the Games, the OCA members invited to participate in the Games, government officials with invitation from other countries and regions, and Asian Game Identity and Accreditation Card (EAGIAC) holders, each person is allowed to bring only one accompanying dog or cat for entry. The aforesaid dogs or cats can be discharged after passing the quarantine provided that the effective quarantine and vaccination against rabies certificates issued by the animal and plant quarantine authorities of the source countries or regions were submitted. The accompanying animals without effective quarantine and vaccination against rabies certificates will be repatriated within the stipulated time or killed in a humanitarian manner.

  IX. All the wooden packing materials of aforesaid goods shall undergo quarantine and disinfesting treatment at the exporting country or region in advance and bear a special International Plant Protection Convention (IPPC) mark. Only after that, it is allowed for entry. The wooden packing materials shall be collected to the designated place for quarantine and disposal by the inspection and quarantine authorities after entry.

  Annex 3:

  THE LIST OF PRODUCTS THAT NEED IMPORTATION QUARANTINE APPROVAL FOR ENTERING CHINA

  1. Approval Range of the Animal Quarantine

  (1) Live animal: Animal (referring to domestic and wild animals namely domestic animal, birds, beast, snakes, turtles, fish, shrimp, crab, shellfish, silkworm, buzzer, etc.), embryos, semen, hatching eggs and other animal genetic material;

  (2) Edible animal products: meat and its products (including internal organs), eggs, milk;

  (3) Non-edible animal products: hides category, hair type, bone, hoof, angle and its products, gelatin, Cocoon, animal-derived feed and feed additives, feed whey, fish meal, meat powder, bone meal, meat meal tankage, grease, blood meal, blood, organic fertilizer containing animal ingredients.

  However the following items do not require quarantine approval: wet blue (dry) skin, tanned fur, washed up down, washed up hair, carbonation hair, tops, shellfish, aquatic products, and bee products, and egg products (excluding fresh eggs), and milk and milk products, cooked meat products (namely sausage, ham, canned meat, edible high-temperature refining animal fats).

  2. Approval Range of the Plant Quarantine

  (1) Fruit and Vegetables: fresh fruit, tomato, eggplant, pepper;

  (2) Tobaccos: tobacco leafs and tobacco flakes;

  (3) Grains: wheat, corn, rice, barley, rye, oats, sorghum, etc and their processed products, namely malt, etc;

  (4) Beans categories: soybeans, mung beans, peas, Chidou, broad beans, chickpeas;

  (5) Potato categories: potato, cassava, sweet potato and their processed products;

  (6) Feedstuffs: wheat bran, soybean cake, soybean meal;

  (7) Other Categories: plant cultivation media.

  However the following items do not require quarantine approval:: cereal processed products (rice, wheat flour, rice flour, starch, etc.), potato processed products (such as potato powder), plant-derived feed additive, lactic acid bacteria and yeast.

  3. The Scope of Concessionary

  Animal and plant pathogens (including bacteria strain, virus strain), pests and other harmful organisms, plants and animals. Plants and animal products, and other quarantine objects, which from animal and plant epidemic countries and regions. Animal carcasses and soil coming from disease-endemic countries and regions.

  For the list of plant quarantine concessionary, please refer to The List of Objects Prohibited from Entering China for the plant importing quarantine of the People’s Republic of China.

  The Scope of Quarantine of Cross-boundary Animal:

  Cross-boundary animals.

  Annex 4:

  LIST OF THE PROHIBITED PRODUCTS THAT CAN'T ENTER CHINA

  1. China is banning the entry of beef and beef processed products coming from the following countries:

  America: United States (exclude the debone beef from cattle younger than 30 months of age which can meet the inspection and quarantine requirement of CIQ), Canada, Colombia, Argentina (only limited to the border area between 2200 kms length and 15 kms width in the northern area), Bolivia, Ecuador, Venezuela, Peru, Paraguay, Brazil (exclude Santa Catarina State, Acre State, Rio Grande do Su State, Rondonia State).

  Cause: foot and mouth disease (aftosa) or rinderpest, or the bovine spongiform encephalopathy (BSE) disease areas.

  2. China is banning the entry of mutton and mutton processed products coming from the following countries and regions:

  All Africa

  Phytosanitary and Marking Requirement for Inward Wooden Packing Materials

  Applicable to: all countries/regions (incl. Hong Kong SAR, Macau SAR and Taiwan)

  Supervision & Administration Scope:

  All wooden packing materials free of artificial composition, heat treatment or pressurization process which are used for the purposes of bearing, packing, cushioning, supporting and reinforcing etc.

  Such as wooden case, crate, wooden pallet, wooden frame, wooden barrel, wooden axel, wedge, pad, sleeper or pad etc.

  Scope of Exemption:

  Wooden materials artificially composed, heated or pressurized etc, such as plywood, shaving board or fiber board etc, including sheet metal, peeler core, sawdust, wood wool, wood shavings etc, and the wooden materials with the thickness equaling to or less than 6mm.

  Phytosanitary and Marking Requirement:

  All inward wooden packing materials shall be treated and marked (as shown in the following chart) by the enterprises qualified by the plant quarantine authority of exporting countries or regions governments against the phytosanitary methods and marking requirements certified in No. 32 Announcement (2005) released by the General Administration of Quality Supervision, Inspection and Quarantine of the People’s Republic of China.

  The marking shall include:

  IPPC – Abbreviation of “International Plant Protection Convention”;

  XX – the two-letter country code prescribed by the International Standardization Organization (ISO) ;

  OOO – Code of wooden packing material production enterprise approved by official plant quarantine authority in exporting countries or regions;

  YY – The certified phytosanitary treatment measure, e.g. Methyl Bromide Fumigating – MB, Heat Treatment - HT

  Markings shall be applied to the legible place of wooden packing material, at least on its opposite sides. The markings applied shall be clear, visible and permanent, and shall not be in red or orange.

  Commitment Letter on Letter of Guarantee for Temporary Inward Materials

  To: Tianjin East Asian Games Organizing Committee (“TEAGOC”)

  From: (the “End User of Letter of Guarantee”).

  Date:

  WHEREAS:

  (i) For the purposes of the 6th East Asian Games, test events and other relevant events and activities organized by Tianjin Organizing Committee (the “Specific Purposes”), it is intended to transport relevant goods (the “Temporary Inward Materials”) into the territory of China and re-export such goods out of China within the time limit specified by Customs.

  (ii) In accordance with the relevant commitments made by it under the Host City Contract, Tianjin Organizing Committee will, pursuant to related laws and regulations of China, assist the End User of Letter of Guarantee in handling customs clearance procedures for the Temporary Inward Materials without any duties or taxes being payable.

  To this end, Tianjin Organizing Committee provided to Customs a demand guarantee issued by bank (the “Letter of Guarantee”), in accordance with the requirements of laws and regulations of China.

  Based upon the abovementioned description, the End User of Letter of Guarantee hereby agrees to make the following commitments:

  1. The End User of Letter of Guarantee shall submit a goods list (the “Goods List”) to related department of Tianjin Organizing Committee at least three months before the Temporary Inward Materials are transported into China through relevant port under the administrative jurisdiction of Customs. The Goods List shall be truly and accurately completed and shall include the following items:

  (1) Name and description of goods;

  (2) Intended purpose of goods;

  (3) Quantity, weight and size of goods;

  (4) Value of goods (including unit price and total price);

  (5) Time and port at which the goods are proposed to be transported into China and re-exported out of China;

  (6) Name, contact person, and contact information of the importation declarer designated by the End User of Letter of Guarantee inside China (consignee);

  (7) Other items required by Tianjin Organizing Committee.

  2. The End User of Letter of Guarantee covenants to abide by the relevant provisions applicable to the Temporary Inward Materials under Chinese laws, in particular, including:

  (1) The End User of Letter of Guarantee shall, at the time and port specified in the Goods List, transport the Temporary Inward Materials into China and use such goods for Specific Purposes only.

  (2) The End User of Letter of Guarantee has the responsibility to carry out the control and management measures required by Tianjin Organizing Committee and Customs over the Temporary Inward Materials.

  (3) Before the relevant Temporary Inward Materials are re-exported out of China, the End User of Letter of Guarantee shall immediately notify related department of Tianjin Organizing Committee and the Logistics Center of Tianjin Organizing Committeeof the related information in written form.

  (4) Where any Temporary Inward Materials are destroyed, stolen, or reduced in quantity due to normal consumption before re-exportation, the End User of Letter of Guarantee shall immediately notify related department of Tianjin Organizing Committee of relevant situation (incl. corresponding supporting documents) in written form. Where the End User of Letter of Guarantee proposes to dispose of any Temporary Inward Materials by means of auction, transfer or donation, the End User of Letter of Guarantee shall notify Tianjin Organizing Committee in advance of its proposed disposal in written form, obtain prior approval of Customs and complete the due importation procedures and pay taxes and fees according to law.

  Where any Temporary Inward Materials are not re-exported out of China by specified time limit due to whatever reason, the End User of Letter of Guarantee shall promptly notify related department of Tianjin Organizing Committee in writing of the current status of the goods remained in China (including without limitation, the name, actual location, party in control of the goods and owners of the goods, etc.), and provide the documents requested by Tianjin Organizing Committee in this regard.

  3. The End User of Letter of Guarantee covenants that, if due to a breach by the End User of Letter of Guarantee of the provisions under Article 2 hereof, or a violation of other relevant laws and regulations of China committed by the End User of Letter of Guarantee, it will have to pay any taxes and penalties to the Customs.

  4. The End User of Letter of Guarantee undertakes to purchase and maintain necessary insurance (if necessary) upon the request of Tianjin Customs and Tianjin Organizing Committee.

  5. The End User of Letter of Guarantee undertakes to exempt Tianjin Organizing Committee, its management personnel, employees, agents, appointees or volunteers from any possible compensation liability (including but not limited to, fines, penalties, losses or expenses) arising from the performance or non-performance by the End User of Letter of Guarantee of relevant matters under the Commitment Letter.

  6. The Commitment Letter is prepared in Chinese and attached with English translation. Should there be any inconsistency between the Chinese version and the English translation, the Chinese version shall prevail.

  7. The Commitment Letter shall be construed as the agreement between the End User of Letter of Guarantee and Tianjin Organizing Committee and shall be governed by laws of China. Disputes arising from or in connection with the Commitment Letter shall be appealed to China International Economic and Trade Arbitration Commission for arbitration in Beijing.

  8. The Commitment Letter shall become effective upon the date of execution and seal by the End User of Letter of Guarantee. The Commitment Letter will be executed in three original copies, with one held by the End User of Letter of Guarantee,one held by related department of Tianjin Organizing Committee, and the remaining one delivered to the Logistics Center of Tianjin Organizing Committee.
